This notice applies to:
Diving Bell is generally the controller of the personal information described in this notice. This means we decide why and how it is used.
In limited situations, we may process information solely on another organisation's documented instructions. In those situations, we act as a processor and that organisation is the controller. Its privacy information will also apply.
Depending on our relationship with you, we may collect and use:
We aim to collect only information that is relevant to the particular relationship or activity.
We may receive information directly from you, from Talent or their personal service company, or from someone acting with authority on their behalf. We may also receive it from clients, agencies, platforms, representatives, professional advisers, public registers, social-media profiles and other publicly available sources.
UK data-protection law requires us to have a lawful basis for each use of personal information. The bases that most commonly apply are set out below.
Where we rely on legitimate interests, those interests include operating and developing a responsible talent-management business, securing and delivering opportunities, maintaining professional relationships, receiving payment, preventing fraud, protecting systems and enforcing legal rights. We consider whether the use is necessary and balance these interests against the rights and reasonable expectations of the people affected.
Some information is needed to enter into or perform a contract, make or receive payments, or meet legal requirements. If it is not provided, we may be unable to consider an enquiry, offer or continue representation, complete a commercial opportunity or make a payment. We will explain where providing particular information is mandatory.
We do not routinely ask for special category information. We may need limited health, accessibility, diversity or safeguarding information where it is relevant to a person's welfare, support, access needs or an opportunity. We will use an additional legal condition where the law requires one, such as explicit consent, employment and social-protection law, protection of vital interests, information made manifestly public by the person concerned, or the establishment, exercise or defence of legal claims.
We process criminal-offence information only where necessary, lawful and subject to appropriate safeguards.
Where reasonably necessary for the purposes in this notice, we may share relevant information with:
We share only what is reasonably necessary and require recipients to handle information appropriately. Some recipients, such as clients, banks, professional advisers and regulators, may act as controllers in their own right and apply their own privacy notices.
Talent opportunities and our suppliers can involve countries outside the UK. Where personal information is transferred internationally, we use a lawful transfer mechanism where one is required. This may include UK adequacy regulations, approved contractual safeguards such as the UK International Data Transfer Agreement or UK Addendum, and any necessary supplementary measures. We use a legal exception only where the law permits.
Contact us if you would like more information about the safeguard used for a particular transfer.
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to perform contracts, administer and reconcile payments, maintain accounts, meet tax and regulatory requirements, manage disputes and establish or defend legal claims.
The appropriate period depends on the nature and sensitivity of the information, the relationship and contract involved, relevant limitation periods, legal and professional requirements, and whether the information is needed to resolve an issue. When information is no longer required, we delete it, anonymise it or securely place it beyond use.
We use proportionate technical and organisational measures designed to protect personal information against accidental or unlawful loss, alteration, access, disclosure or use. Access is limited to people and providers who need the information for an authorised purpose. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Depending on the circumstances, you may have the right to:
You have an absolute right to object to the use of your personal information for direct marketing.
